1. Overview
AlphaPlay UK respects the intellectual property rights of content creators, broadcasters, and rights holders worldwide. This Digital Millennium Copyright Act (“DMCA”) policy is provided in accordance with the DMCA (17 U.S.C. § 512) and equivalent provisions under UK copyright law, including the Copyright, Designs and Patents Act 1988.
AlphaPlay UK acts as a reseller of third-party digital entertainment middleware and does not produce, host, broadcast, or own any of the content streams accessed through the service. However, we are committed to responding promptly and appropriately to valid copyright infringement notices.
2. Reporting Copyright Infringement
If you believe that content accessible through AlphaPlay UK services infringes your copyright or the copyright of someone you represent, you may submit a written notice of claimed infringement to our designated contact below.
To be effective, the notice must meet all requirements set out in Section 3 of this policy. Incomplete or inaccurate notices may not be actioned.
Please note that submitting a false or fraudulent infringement notice may expose you to legal liability under Section 512(f) of the DMCA or applicable UK law.
3. Notice Requirements
A valid DMCA notice must include all of the following:
- Identification of the copyrighted work: A description of the copyrighted work you claim has been infringed, or a representative list if multiple works are involved.
- Identification of the infringing material: Sufficiently detailed information to allow us to locate the specific material — for example, a URL, channel name, or content description.
- Your contact information: Your full name, mailing address, telephone number, and email address.
- Good faith statement: A statement that you have a good faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.
- Accuracy statement: A statement that the information in your notice is accurate, and — under penalty of perjury — that you are the copyright owner or are authorised to act on their behalf.
- Signature: A physical or electronic signature of the person authorised to act on behalf of the copyright owner.
4. How We Process Notices
Upon receipt of a valid DMCA notice, AlphaPlay UK will:
- Acknowledge receipt of the notice within 5 business days.
- Review the notice to confirm it meets statutory requirements.
- Where the notice is valid, take appropriate action, which may include disabling access to the relevant content or escalating the matter to the upstream provider.
- Notify the alleged infringer where practicable.
- Maintain a record of the notice and our response.
AlphaPlay UK acts in good faith in processing infringement notices. We are not liable for any failure to remove content where the notice does not comply with statutory requirements or where the content is hosted by a third party outside our direct control.
5. Counter-Notice Procedure
If you believe that content was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notice to us. A valid counter-notice must include:
- Your physical or electronic signature.
- Identification of the material that was removed and its location before removal.
- A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the courts of England and Wales (or, for US-based individuals, the relevant US federal district court).
Upon receipt of a valid counter-notice, we will notify the original complainant. If the complainant does not initiate legal proceedings within 10 to 14 business days, we may restore access to the removed material.
6. Repeat Infringers
In accordance with the DMCA and UK copyright law, AlphaPlay UK maintains a policy of terminating the subscriptions of users who are determined to be repeat copyright infringers. Termination may occur without prior warning and without refund.
7. Disclaimer
AlphaPlay UK does not host, store, or produce the content streams accessible through the service. We provide access to third-party IPTV middleware as a reseller. Rights holders who believe their content is being distributed unlawfully through the upstream provider should also contact the relevant content delivery network, broadcaster, or IPTV provider directly.
AlphaPlay UK does not endorse, condone, or facilitate copyright infringement. Our Acceptable Use Policy expressly prohibits customers from using the service for any unlawful purpose, including recording or redistributing streamed content.
